Terms of Use

1. Purpose
These Terms of Use govern the rights and obligations regarding the use of the TCG Holo Binder mobile application. By downloading, creating an account for, or using the application, you accept these terms.
2. Nature of the Service
TCG Holo Binder is an independent collection management application developed to organize, store, and manage physical collectible cards in digital form. The application is not a card game and does not include card battles, booster-opening simulation, digital card generation, or any game mechanic. It is not the official digital version of any card game and has not been developed, licensed, approved, or endorsed by any rights holder.
Users may add card photos, notes, and other supported content to the application. The developer is not required to pre-check or verify the accuracy, legality, copyright status, or whether uploaded content actually belongs to a collectible card. Each user is responsible for the content they upload and for any legal consequences arising from it. Content reported or found to be infringing or unlawful may be removed or access to it may be restricted.
3. Accounts
Users may create an account by using Sign in with Apple, Sign in with Google, or e-mail where supported. Users are responsible for the security of their account information.
4. User Obligations
Users agree to use the application lawfully, not to infringe third-party rights, not to bypass security mechanisms, and not to misuse the service through automation, bots, or similar methods.
Users may add card photos, gallery images, notes, and other supported content. The developer is not required to pre-check whether uploaded content is truly related to a collectible card, accurate, lawful, or free of copyright issues. The relevant user is responsible for all content they upload and the legal consequences of that content.
5. Card Information and OCR
Card recognition is performed through OCR and image analysis technologies. Since recognition results are generated automatically, they are not guaranteed to always be accurate, complete, or up to date.
6. Price Information
Prices or information obtained from third-party sources are provided for informational purposes only. They are not investment, buying, or selling advice.
7. Advertisements and Promotions
The application may show advertisements, sponsored content, store promotions, campaigns, developer-owned application or service promotions, and third-party promotions or referrals in free or paid versions. Showing these promotions does not mean that TCG Holo Binder is the seller, buyer, marketplace, or commercial intermediary of the relevant product or service. Responsibility for third-party products, services, stores, campaigns, or advertising content belongs to the relevant third party.
8. Intellectual Property Rights
The TCG Holo Binder software, user interface, design, database structure, original content, and other creative elements are protected under applicable intellectual property laws. Pokémon, Yu-Gi-Oh!, One Piece, Magic: The Gathering, and other card game names, logos, characters, and works belong to their respective rights holders. The application does not claim ownership over those rights.
9. User Content
The legality of card photos, notes, binder content, and other data added by users is the responsibility of the user. The user declares that they have the necessary usage rights over the content they upload. Clearly unlawful content may be removed or access to it may be restricted.
10. Plus Membership and Purchases
Plus membership and in-app purchases are offered through the authorized app store infrastructure. Subscription management, cancellation, and refund processes are subject to the rules of the relevant store. The developer does not access payment card information.
11. Slot System
Slots offered within the application represent the card capacity that can be saved to the collection. Permanent rights purchased may be re-verified through the “Restore Purchases” mechanism to the extent allowed by the relevant store.
12. Account Suspension
The developer may temporarily restrict or terminate an account if security violations, unlawful use, abuse of the service, automation use, or activities infringing third-party rights are detected.
13. Limitation of Liability
The application is provided as is. To the extent permitted by applicable law, the developer is not liable for indirect damages arising from service interruptions, errors caused by third-party services, OCR results, price data, or issues originating from the user’s device.
14. Force Majeure
Natural disasters, war, terrorist incidents, internet infrastructure outages, official authority decisions, and similar events beyond the developer’s reasonable control are considered force majeure.
15. Governing Law and Effectiveness
These Terms of Use are governed by the laws of the Republic of Türkiye, without prejudice to mandatory legal rules. The current version becomes effective on the date it is published and replaces previous versions.
16. Changes to the Service
TCG Holo Binder is continuously developed. New features may be added, existing features may be updated, changed, or removed for technical or legal reasons. Important changes will be announced through the application or official communication channels where appropriate.
17. Third-Party Services
The application may use third-party services for authentication, cloud synchronization, in-app purchases, notifications, or similar functions. The terms of the relevant service providers may apply to the use of these services.
18. Data Security
The developer applies reasonable administrative and technical security measures to protect user data. However, no data transmission over the internet or electronic storage method can be guaranteed to be absolutely secure.
19. Infringement Notices
If a copyright, trademark, or other intellectual property right is believed to be infringed, a notice may be sent to the developer through official support channels. Requests will be reviewed within a reasonable period.
20. No Waiver
Failure to exercise any right under these terms does not mean that the right has been waived. If any provision is found invalid, the validity of the remaining provisions is not affected.
21. Contact
Questions, suggestions, or requests regarding the Terms of Use may be sent through the support section in the application or the developer’s official communication channels.
22. Sharing and User Interactions
In future versions, the application may allow users to share their binders, showcases, surplus card lists, gallery-saved cards, or certain collection information with other users. When enabled by the user, the relevant content may be visible to other users.
TCG Holo Binder is not a marketplace, payment tool, auction platform, or commercial brokerage service. Any conversations, trades, purchases, sales, or other transactions between users are entirely the responsibility of the users.
23. Buying, Selling, and User Interactions
TCG Holo Binder does not provide buying, selling, auction, brokerage, or marketplace services. The application may allow users to display their collections or surplus cards and discover other collectors. However, any conversations, trades, purchases, sales, or other transactions between users are entirely the responsibility of the relevant users. The developer is not a party to these transactions, does not process payments, and gives no guarantee.
24. Storage
The amount and size of content added by the user may affect storage usage, synchronization time, data transfer, and application performance. These effects may vary depending on the device, cloud services, and technical infrastructure used.
25. Account, Synchronization, and Transfer
The user may need to sign in with the same account for cloud synchronization, verification of purchased rights, tracking of slot usage, and transfer of data between devices. If the user signs out, uses a different account, or disables synchronization, access to binders, showcases, gallery, surplus lists, slot usage, or purchased rights may be limited.
Data transfer may be provided through iCloud, app store verification mechanisms, or other synchronization methods supported by the application. The developer may use technical verification mechanisms to preserve data integrity and verify purchased rights.
26. Final Provisions
These Terms of Use become effective on the date of publication. Continued use of the application means acceptance of the current version. The user’s mandatory legal rights are reserved.
Account Deletion and Retained Rights
This permanently deletes all binders, decks, card scans, notes, images, settings, OCR data, and all scan-related information. Your free slot allowance restarts at 20. Purchase records, subscription rights, and information that must legally be retained may be stored on our secure servers, Apple iCloud services, and/or secure cloud infrastructure we use. When you sign in again, only purchased rights are restored.
